We have all heard of the Miranda warning. It requires police to advise
criminal suspects that if they talk, their words can and will be used against
them. This rule does not apply in civil cases. If you have been in a car
accident, and the insurance company for the other driver calls you, you do
not have to talk to them. They won’t warn you, but be assured that if you do
talk, what you say can and will be used against you.
