Troubled New York Hospitals Forgo Coverage for Malpractice

By ANEMONA HARTOCOLLIS Published: July 15, 2012 264 Comments Every hospital makes mistakes. But some New York City hospitals may not have enough money to pay for them. Several of the city’s most troubled hospitals are partially or completely uninsured for malpractice, state records show, forgoing what is considered a standard safeguard across the country. Some have saved money to cover their liabilities, but others have used up their malpractice reserves, meaning that any future awards or settlements could come at the expense of patients’ care, and one hospital has closed its obstetric practice, in part out of fear of lawsuits. One facility’s record of alleged violence

Chicago police responded to 34 reports alleging battery, assault or sexual violence from 2009 to 2011 at Rainbow Beach Care Center, while health inspectors cited other violence. Inspectors said the facility did not have a plan for dealing with his aggressive behavior. Hospital conspired to defame surgeon, says lawyer. Published: February 8, 2012 How bad was the rift between hospital officials at the University of Illinois at Chicago and its one-time chief of surgery? So bad that when the hospital heard that both it and colorectal surgeon Herand Abcarian, MD, were about to be sued for malpractice for the death of one of his patients, the hospital settled with the plaintiff's son for $950,000 - without letting Dr. Abcarian know. According to court documents, the university specifically instructed the plaintiff's attorney to individually sue Dr. Abcarian and not serve him. The hospital then reported...

Peoples Energy accuses Tetzlaff, firm of malpractice in Enron case

By: Joseph B. Cahill and Todd J. Behme December 16, 2010 (Crain's) — Peoples Energy sued high-profile Chicago lawyer Theodore Tetzlaff on Wednesday for malpractice, alleging he authorized the destruction of documents in a class-action suit in violation of a court order. The lawsuit, which also names Mr. Tetzlaff's firm, Ungaretti & Harris LLP, seeks at least $4.66 million. Most of that is the difference between the amount for which Peoples settled the case and the lower amount it believes would have been accepted had the documents not been destroyed, according to the complaint, filed in Cook County Circuit Court. via Peoples Energy...
